One of the most common types of medical practice does not involve what a doctor directly does wrong, but instead what a doctor fails to do. The definition of medical malpractice is “professional negligence by act or omission by a health care provider which causes injury or death to the patient.” Failure to diagnose is when a doctor completely misses a serious condition in a patient despite the presence of obvious signs or symptoms. Failure to diagnose would be an act of omission.
