When a person is in need of emergent medical care, or even when she is simply seeking a routine evaluation, there is no choice but to place one’s faith wholly in the professional skills, experience, and abilities of a doctor. This is no small feat, considering the gravity of the situation and the potential severity of the consequences if a doctor or other medical professional commits a serious error in the administration of care. The failure to attain the expected standard of care, as characterized by making decisions or prescribing a course of treatment that would not be chosen by a reasonable doctor in the same situation, is termed medical malpractice.
